Terms of Service & Beta Testing Agreement (EULA)
§ 1. General Provisions and Definitions
1. These Terms of Service govern the usage of the jayb.it website, the free product notification newsletter, and the participation in the pre-release testing program for Jaybit Copy (Beta).
2. The Service Provider and Software Author is the creator of jayb.it (an individual operating in a personal capacity). Contact: contact@jayb.it.
3. Definitions:
- Service / Website: The website operated under
jayb.itand its subpages. - User / Tester: Any individual or entity using the website, subscribing to notifications, or downloading pre-release software builds.
- Software / Application: The desktop software Jaybit Copy for verified, smart file importing and copying.
- Beta Version: An experimental pre-release software build provided free of charge for evaluation and technical feedback.
§ 2. Technical Requirements
1. Accessing the website requires an active Internet connection and a modern web browser with JavaScript enabled.
2. Running Jaybit Copy Beta requires a compatible operating system (currently: macOS 12.0+ on Apple Silicon M1–M6 / ARM64).
§ 3. Free Newsletter & Launch Notifications
1. The newsletter service is entirely free and voluntary.
2. Subscriptions can be cancelled at any time by clicking the unsubscribe link present in each email or by contacting contact@jayb.it.
§ 4. Beta Software License Agreement (Beta EULA)
1. Grant of Evaluation License: The Author grants the Tester a revocable, non-exclusive, non-transferable, royalty-free license to install and test the Beta Version of Jaybit Copy solely for evaluation purposes.
⚠️ "AS IS" Disclaimer (Experimental Software)
The Beta Version is provided strictly "AS IS" without warranties of any kind (express or implied). Pre-release builds may contain bugs, defects, or unexpected behaviors. Testers are strongly advised to maintain independent backups of critical data before performing disk copy operations.
2. Limitation of Liability: To the maximum extent permitted by applicable law, the Author shall not be liable for any direct, indirect, incidental, or consequential damages, loss of data, or hardware disruption arising from the use of beta builds.
3. Validity & Kill-Switch: Beta builds may verify validity status via a remote manifest (`version-status.json`). The Author reserves the right to retire beta builds or enforce updates at any time.
4. Restrictions: Testers shall not reverse-engineer, decompile, modify binaries, or redistribute unauthorized copies without express written permission.
§ 5. Intellectual Property
1. All copyrights, intellectual property rights, trademarks, visual styles, and source code of Jaybit and Jaybit Copy remain the exclusive property of the Author.
2. Any suggestions, feedback, or ideas submitted during testing may be incorporated into future releases without obligation of compensation.
§ 6. Future Commercial Licensing (Merchant of Record - Phase 2)
1. Upon the public release of commercial production licenses (v1.0+), order processing, payment collection, invoicing, and tax remittance (VAT/Sales Tax) will be conducted by an authorized Merchant of Record (e.g. Paddle, Lemon Squeezy).
2. Under this model, the Merchant of Record acts as the legal seller to the end customer, while the Author provides software delivery, updates, and technical support.

2. Inquiries will be reviewed and answered within 14 business days.
§ 8. Governing Law
1. These terms are governed by the applicable laws of the European Union and the Republic of Poland.
